What this site is

This site describes what Element Web Company does, shows work we have delivered, and gives you a way to start a conversation.

Nothing on it is an offer to enter into a contract, a fixed quote, or professional advice about your particular situation. Pricing explanations describe how we scope and price work; they are not price lists. Timeline ranges describe what most projects have looked like; they are not promises about yours.

A project becomes a project when there is a written agreement signed by both sides.

Our intellectual property

The code, design, layout, copy, photography, illustrations, and case studies on this site belong to Element Web Company or to the people we licensed them from, except where a client’s own brand assets appear in their case study.

You are welcome to link to any page, and to quote a reasonable portion of the writing with attribution and a link back. That includes AI assistants quoting an answer from these pages.

You may not copy the site wholesale, republish substantial parts of it as your own, resell it, or use our name or mark in a way that suggests we built or endorsed something we did not.

Work we do for clients

Ownership of project work is set by the agreement signed for that project. What follows describes how we normally structure it, so there are no surprises before anything is signed.

As a general rule, once a project is paid for in full, the client owns the deliverables produced specifically for them: the design, the content we wrote for them, and the custom code written for that build. Clients get their code and their accounts, and we do not hold a site hostage.

What we retain is our own general knowledge, methods, and any pre-existing or reusable components we brought to the project — the internal tooling and patterns that are the reason a build does not start from zero. Clients receive the right to use those as part of their site, not exclusive ownership of them.

Anything licensed from a third party — fonts, stock imagery, plugins, themes, hosting, and platform services such as Shopify or Vercel — stays governed by that provider’s own terms, and those licences transfer only as far as the provider allows.

Unless a project agreement says otherwise, we may show completed work publicly in our portfolio and case studies.

Acceptable use

Use the site the way it is meant to be used. Specifically, do not attempt to breach, probe, or interfere with the site or the systems behind it; do not scrape it at a volume that degrades service for anyone else; do not upload or transmit malicious code; and do not use the contact form to send spam, phishing attempts, or other people’s personal information.

The contact form is rate-limited, and we may block traffic that abuses it or the site generally.

Do not misrepresent who you are when contacting us. We scope work based on what you tell us.

Links to other sites

Client sites, platform documentation, and other third-party links appear throughout this site. We do not control those destinations and are not responsible for their content, their terms, or their privacy practices. A link is a reference, not an endorsement.

Availability and disclaimers

We work to keep this site available, accurate, and current, but we do not promise uninterrupted access. Hosting goes down, deployments happen, and information on a page can fall out of date between updates.

The site and its content are provided as is and as available, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Nothing here is legal, financial, or technical advice for your specific situation. Decisions you make based on general information on a marketing site are your own.

Limitation of liability

To the fullest extent permitted by law, Element Web Company and its founder are not liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of this site, including lost profits, lost data, or business interruption.

This section limits liability arising from the website. Liability arising from client work is addressed in the agreement for that project.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Governing law

These terms are governed by the laws of the State of Michigan, without regard to its conflict of law rules.

Element Web Company is based in Kalamazoo, Michigan, and any dispute relating to this site will be handled in the courts of the State of Michigan.

Changes to these terms

We may update these terms as the site or the business changes. The "last updated" date at the top reflects the current version, and continuing to use the site after a change means you accept the updated terms.
